Get your drivers ready.
Boot into safe mode and remove all traces of the modem.
Re-boot into normal mode and re-install drivers.

Thanks for the help. Now I have a new problem I have no clue how to start in safe mode I cant seem to find my book thinks kids got it. There is a spot in msconfig but it has 4 spots next to safemode and i dont know which ones I should have marked. There is minimal network DSREPAIR and minimal (ALTERNATESHELL) and do I only mark the SAFEBOOT option there is also /NOGUIBOOT /BOOTLOG /BASEVIDEO AND /SOS. I appreciate all your help.

/SAFEBOOT (minimal) from msconfig
... or just keep pressing F8 during start up.

Ok I did the safe mode, still not working when i query modem it says "The modem failed to respond. Make sure it is properly connected and turned on. If internal modem or it is connected verify the interrupt for the port is properly set." Same pc doctor results. When I reinstall my drivers it has been different setup couple times, most of the time it takes me to the regular install screen for gateway drivers or applications and sometimes it opens up and install program for the modem that looks more like the add programs when they are added. Do you think that could be problem? It very rarely opens up the 2nd way but its totally different. I dont do anything different just sometimes it has mind of its own I guess.

Please follow these instructions once in safe mode. I know the modem will not querry, safe mode will not fix that. You need to see if the drivers are corrupt or the modem is bad. Removing and reinstalling the drivers will fix the drivers if it is that and you will need to replace the modem if it does not.

Well thanks for the help. Think I am gonna end up having to get a new one. I did remove drivers for modem from device manager and add remove programs in safe mode. I queried the modem after reinstalling but it still didnt work. I am going to get a new one or maybe its bout time to say bye to dial up all together.
